
The Employment Equity Amendment Bill is currently awaiting President Cyril Ramaphosa’s signature before it will be published in the Government Gazette and become an Amendment to the existing legislation.
The general consensus in the industry is that it will be enacted by Parliament later this year or possibly in early 2023. The current legislation is therefore still to be applied and all employers who are deemed as “designated” i.e 50 or more employees or those exceeding the relevant turnover threshold, still need to comply with all the relevant sections of the Act.
This includes reporting to the Director General of the Department of Employment & Labour in terms of Section 21 and the monitoring of an existing Employment Equity Plan. Reporting needs to be done electronically by no later than 15 January 2023, unless the legislation is effected before then and specifically states that smaller employers i.e. less than 50 employees does not need to report for the 2022 reporting period.
